Terms of Use

Agreement

These Terms of Use ("Terms") are a legal agreement between you and Jaime Quezada, an individual developer based in California, United States ("Distill," "we," "us," or "our"), governing your use of the Distill iOS app, its Share Extension, and related services (collectively, the "App").

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App. These Terms incorporate our Privacy Policy by reference.

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

License

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on an iOS device that you own or control, solely for your personal, non-commercial use.

This license is provided under the terms of Apple's Licensed Application End User License Agreement ("Apple EULA"), except where these Terms expand or modify those terms. If any conflict exists between these Terms and the Apple EULA, these Terms control, except as to provisions Apple requires — see the "Apple" section below.

Subscriptions

Access to Distill requires an active subscription. All features of the App — including saving articles, viewing AI-generated distillations, organizing your library, and using the "Dive Deeper" chat — are included in the subscription.

Pricing: Distill is offered as an auto-renewing monthly subscription at $4.99 USD per month. Prices are subject to change, and any price change will be disclosed to you in advance through the App or the App Store.

Free trial: New subscribers who are eligible may receive a 3-day free trial before the first billing cycle begins. Eligibility is determined by Apple based on your Apple ID's subscription history for this App. If you cancel during the trial period, you will not be charged. Once the trial ends, your subscription begins and payment is charged to your Apple ID account at the then-current price.

Billing: Your subscription automatically renews for the same term at the then-current price unless you cancel at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Managing and cancelling: You can manage or cancel your subscription at any time by going to Settings → [Your Name] → Subscriptions on your iOS device, or in the App Store. Deleting the App does not cancel your subscription.

Usage limits: To maintain service quality, Distill is subject to daily rate limits of 10 article distillations and 15 chat messages per day. These limits reset at midnight and are not cumulative. Most users will not encounter them under normal use.

Refunds: All subscription purchases are handled by Apple. Refund requests must be submitted to Apple through reportaproblem.apple.com. We do not issue refunds directly and have no ability to process them.

Your Content

The articles you save, the distillations generated from them, and the chat messages you create are your content ("Your Content"). You retain all ownership and rights you have in Your Content. We do not claim ownership of any article you save.

To operate the App's features, you grant us a limited, worldwide, royalty-free license to process Your Content solely as described in our Privacy Policy — specifically, to transmit article text and chat messages to our API proxy and to Anthropic's Claude API for the purpose of generating distillations and chat responses on your behalf. This license exists only to provide the App's features to you; we do not use Your Content for training AI models, advertising, or any other purpose.

Third-Party Content and Copyright

The articles you save through the App are authored and owned by their respective publishers, not by us or by you. You are solely responsible for ensuring that your use of any article through the App complies with the source publisher's terms of service and applicable copyright law.

Distill is a personal reading and knowledge tool. It is not a publishing platform. You may not use the App to redistribute, republish, or commercially exploit articles or other content that you do not have the right to use.

If you believe that content accessible through the App infringes your copyright, you may send a notice under the Digital Millennium Copyright Act (DMCA) to the contact address listed below. The App does not host third-party content — it fetches articles directly from publisher websites at your request and stores them locally on your device.

AI-Generated Content

The App uses a third-party artificial intelligence service (Anthropic's Claude API) to generate distillations of articles and to produce chat responses. You acknowledge and agree that:

• AI-generated output may be inaccurate, incomplete, biased, or otherwise unreliable. You should independently verify any important information before acting on it.
• AI output is not, and should not be relied on as, professional advice of any kind — including medical, legal, financial, tax, mental health, or safety advice.
• The quality and accuracy of AI output depends heavily on the source article you provide. The AI does not evaluate the trustworthiness of the source.
• Identical inputs may produce different outputs on different occasions due to the nature of the underlying AI model.
• You are solely responsible for how you use and act on AI-generated content.

Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent expressly permitted by applicable law
• Access our API proxy, Anthropic, or any other service used by the App other than through the App's intended user interface
• Use the App to process or generate content that is illegal, infringes a third party's rights, or violates any applicable law
• Use the App to generate content that is defamatory, harassing, sexually explicit involving minors, or designed to harm others
• Attempt to circumvent any subscription paywall, rate limit, or other access control
• Use automated means (bots, scripts, scrapers) to interact with the App or our API
• Resell, rent, lease, sublicense, or otherwise transfer access to the App
• Interfere with the operation of the App or our infrastructure, or attempt to probe, scan, or test its security

Our Intellectual Property

The App itself — including the Distill name, logo, visual design, source code, and all content we create (such as system prompts and UI text) — is our intellectual property and is protected by copyright, trademark, and other laws. These Terms do not grant you any ownership of our intellectual property, and all rights not expressly granted to you are reserved.

Third-Party Services

The App relies on the following third-party services, each of which has its own terms:

• Apple Inc. — app distribution, device platform, and subscription payment processing (Apple EULA)
• Anthropic, PBC — AI processing via the Claude API (Anthropic Terms)
• Vercel Inc. — hosting the API proxy that connects the App to Anthropic (Vercel Terms)
• Publisher websites — the sources from which you save articles, each governed by the publisher's own terms

We are not responsible for the practices of these third parties. Your use of third-party services through the App is at your own risk.

Service Availability and Changes

We make no guarantee that the App or its features will be available at all times. We may modify, suspend, or discontinue any feature of the App — including the AI distillation and chat features — at any time, with or without notice. If we discontinue a paid feature, we will make reasonable efforts to notify active subscribers in advance and, where appropriate, coordinate with Apple regarding pro-rated refunds.

Termination

You may stop using the App at any time by deleting it from your device. If you have an active Distill subscription, you must cancel it through your iOS Subscriptions settings to stop future charges.

We may suspend or terminate your access to the App if you materially violate these Terms. On termination, your license to use the App ends immediately, though your locally stored library remains on your device.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components, or that AI-generated output will be accurate, reliable, or suitable for any particular purpose. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US FOR DISTILL PRO IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) TEN U.S. DOLLARS ($10.00).

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Jaime Quezada from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (i) your use or misuse of the App, (ii) Your Content, (iii) your violation of these Terms, or (iv) your violation of any rights of another party, including any third-party publisher whose content you save through the App.

Apple-Specific Terms

You acknowledge that these Terms are between you and Jaime Quezada only, and not with Apple Inc. Apple is not responsible for the App or its content. Specifically:

• Apple has no obligation to provide any maintenance or support for the App.
• In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the App's purchase price (if any) to you; to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims you have relating to the App, including product liability claims, consumer protection claims, or claims that the App fails to conform to any legal or regulatory requirement.
• If any third party claims that the App or your use of the App infringes that party's intellectual property rights, Jaime Quezada — not Apple — is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Export Controls

The App is intended for distribution in the United States. You may not export or re-export the App, directly or indirectly, in violation of any U.S. export laws or regulations, or to any country or individual prohibited from receiving U.S. exports.

Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles. You and Jaime Quezada agree that any dispute arising out of or relating to these Terms or the App will be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

You and Jaime Quezada agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, provide notice through the App or the App Store release notes. Your continued use of the App after changes become effective constitutes your acceptance of the updated Terms.

Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements. If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms at our discretion.
